Transport Conditions

We work exclusively on the basis of the German Freight Forwarders’ Standard Terms and Conditions 2017 (Allgemeine Deutsche Spediteurbedingungen 2017) - ADSp 2017

Note: The ADSp 2017 deviate from the law in clause 23 with regard to the maximum liability amount for damage to goods (§ 431 HGB) by limiting the liability to 2 SDR/Kg in the case of multimodal transports including carriage by sea and in the case of an unknown place of damage, and otherwise additionally limiting the standard liability of 8.33 SDR/kg to 1.25 million euros per claim and 2.5 million euros per loss event, but at least 2 SDR/kg.

The following additional conditions apply

  • The freight charges apply to the quantities, volumes and conditions specified in the order.
  • Extra costs (e.g. lifting platform delivery, interim warehousing or additional loading) concerning volume / weight will be invoiced separately and remunerated by the customer.
  • Hazardous goods must be notified in advance when the order is placed.
  • 3 hours for loading and 2 hours for unloading are for free. Each additional hour or part thereof will be charged at € 45,-/h. and remunerated by the client.
  • Cancellation of the order shall be remunerated with 80 % of the agreed freight.
  • CMR or waybill with the recipient's signature (at the place chosen by the recipient) shall be deemed proof of delivery and shall be sent by us within 14 days.
  • Pallets or mash box pallets are not part of the transport order. Tension belts and anti-slip mats are available in the usual quantity and quality. Special requirements for tension belts or anti-slip mats as well as edge protectors in general are excluded. Load securing material provided by the shipper will not be financially reimbursed or returned by us.
  • Status reports are not part of the transport order.
  • We accept no liability for damage to the goods due to improper loading/unloading. Furthermore, the client is liable for damage to the vehicle caused by incorrect loading/unloading. The same applies to exceeding the legal payload and axle load.
  • A ban on reloading requires a separate agreement.
  • A payment term of 45 days shall be deemed agreed.
